Tax Controversy Services
A&M provides Tax Controversy Services by helping clients to prepare for formal and pre-formal audits from the tax authorities, investigations, revisions and procedures covering federal and local and taxes, such as transfer pricing, among others. We help clients navigate the dispute resolution mechanisms provided by Mexican law, supporting collaborative mediation between taxpayers, tax authorities and Prodecon — a Mexican taxpayer defense agency — to reach settlements based on evidence. In addition, we help clients with requested tax refunds that were denied or withdrawn by the Mexican tax authorities and cross-border controversy, such as mutual agreement procedures (MAPs) under double tax treaties signed by Mexico. We can also help achieve reductions to potential surcharges and penalties imposed by the Mexican tax authorities and in the negotiation of Advanced Pricing Agreements or Bilateral Advanced Pricing Agreements.

Our goal is to provide legal and tax defense solutions tailored to meet the specific needs of our clients and to accompany them in every step of the controversy process. Our multidisciplinary teams — tax advisory and tax litigation — are involved from the very beginning all the way through until settlement or litigation, whatever the case may be, to ensure that all different stages of the controversy process are strategically managed.

THE A&M Difference
- Mitigate Exposures: Preparing a defense file permits taxpayers to be ready for inspections and increases chances of being successful. Preparing complete and well supported responses to audits equals better outcomes. If an assessment is imminent, we help clients look for settlement options directly with the authorities or with Prodecon.
- Save Money: Reduced exposure can lead to decreased penalties and surcharges, which results in fewer financial burdens for companies.
- Provide Certainty: Working with the Mexican tax authority to assess credits can result in certainty of the tax treatment for the coming years.
- Adopt Best Risk Management Practices: Implementing risk management practices aims to reduce the different kinds of risk associated with a business, such as reputational risk. It is important for taxpayers to comply with audits and mediations to preserve their reputations.
