February 22, 2017

On February 22, 2017, the Monitor filed its Discharge and Termination Certificate with the Court certifying that all matters to be attended to in connection with the CCAA Proceedings have been completed to the satisfaction of the Monitor. Pursuant to the Order issued by the Court on November 30, 2016, the filing of the Monitor’s Discharge and Termination Certificate terminates the CCAA Proceedings. On July 7, 2016, H.B. White Canada Corp. (“HBW” or the “Applicant”), commenced court-supervised restructuring proceedings under the Companies’ Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended (the “CCAA”).  

On the same day, the Ontario Superior Court of Justice (Commercial List) (the “Court”) granted an order (the “Initial Order”), which, among other things, provides for a stay of proceedings until August 6, 2016 (the “Stay Period”). The Stay Period may be extended by the Court from time to time.

On the same day, the Court issued an order (the “Claims Procedure Order”) approving the claims process whereby persons who assert a Claim against H.B. White Canada Corp. must file a Proof of Claim (with respect to Claims against HBW) or Director/Officer Proof of Claim (with respect to Director/Officer Claims) with the Monitor on or before 5:00 p.m. (Toronto time) on August 22, 2016.

Also pursuant to the Initial Order, Alvarez & Marsal Canada Inc. was appointed as monitor (the “Monitor”) of the business and financial affairs of H.B. White Canada Corp.
