On October 17, 2024, the Ontario Superior Court of Justice (Commercial List) (the “Court”) granted an Order (as amended from time to time, the “Collateral Management Order”) appointing Alvarez & Marsal Canada Inc. as Court-appointed collateral manager (the “Manager”) over the Management Property (as defined in the Collateral Management Order) and authorizing the Manager to take steps to among other things, collect and dispose of the Management Property.

 

Pursuant to an order of the Court dated January 13, 2026 (the “Collection Plan Order”), a Collection Plan was established for the quantification and resolution of claims by the Manager for outstanding amounts owing by certain lessees, co-lessees, guarantors, and other obligors under a lease agreement, guarantee, or similar documentation (a “Lease”) with Tpine Leasing Capital Corporation ("TLCC").

 

If your lease payments are more than sixty days past due under a Lease with TLCC, you may be affected by this Collection Plan. A copy of the Collection Plan Order, an Instruction Letter, and a blank Notice of Dispute form can be found here.

 

To determine whether the Collection Plan applies to you, please review the list maintained by the Manager and the Receiver to see if your lease(s) or VIN(s) appear. The Manager and the Receiver will update the list from time to time. It is your responsibility to monitor the list to see if your lease(s) or VIN(s) have been added. The list can be found here.
