On April 11, 2022, Sungard Availability Services and its subsidiaries and affiliates (listed below and collectively, “Sungard AS” or the “Chapter 11 Debtors”) commenced voluntary reorganization proceedings (the “Chapter 11 Proceedings”) pursuant to Chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the Southern District of Texas (the “U.S. Bankruptcy Court”).

In connection with the Chapter 11 Proceedings, the U.S. Bankruptcy Court has appointed Sungard Availability Services (Canada), Ltd./Sungard, Services de Continuite des Affaires (Canada) Ltee as the foreign representative of the estates of the Chapter 11 Debtors (the “Foreign Representative”). 

On application made by the Foreign Representative, on April 14, 2022, the Ontario Superior Court of Justice (Commercial List) granted orders, among other things, recognizing the Chapter 11 Proceedings as a foreign main proceeding under Part IV of the Companies’ Creditors Arrangement Act (“the CCAA Recognition Proceedings”), staying all proceedings against the Chapter 11 Debtors, and appointing Alvarez & Marsal Canada Inc. as the Information Officer in the Canadian recognition proceedings under the CCAA.  

Bar Date Order:

On May 11, 2022, the U.S. Court entered the Bar Date Order establishing certain dates by which parties holding prepetition claims against the Debtors must file proofs of claim, including requests for payment pursuant to section 503(b)(9) of the Bankruptcy Code (“Proofs of Claim”).  For the avoidance of doubt, there is no separate claims process for creditors of Sungard Availability Services (Canada) Ltd./Sungard, Services de Continuite des Affaires (Canada) Ltee (“Sungard AS Canada”). The U.S. Court has set the following deadlines for filing proofs of claim:

Governmental Bar Date: October 10, 2022
