On June 10, 2024, Nevada Copper Inc. and its subsidiaries (collectively, the “Chapter 11 Debtors”) each voluntarily a filed petition for relief under Chapter 11 of the United States Bankruptcy Code in the Bankruptcy Court of the District of Nevada under Chapter 11 of the United States Bankruptcy Code (the “Chapter 11 Cases”).

In connection with the Chapter 11 Cases, Nevada Copper Inc. was appointed to act as a foreign representative (in such capacity, the “Foreign Representative”) of Nevada Copper Corp., Lion Iron Corp., 06077792 B.C. Ltd., NC Farms LLC and NC Ditch Company LLC (collectively the “Debtors” and each a “Debtor”) for relief pursuant to Part IV of the Companies’ Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended (the “CCAA”) and Section 106 of the Courts of Justice Act, R.S.O. 1990, as amended (the “CJA”). 

On June 21, 2024, the Ontario Superior Court of Justice (Commercial List) granted the Initial Recognition Order and a Supplemental Order (Foreign Main Proceeding) (collectively, the “Recognition Orders”), which among other things, provides for a stay of proceedings for the Debtors pursuant to the CCAA. 

Alvarez & Marsal Canada Inc. is the Information Officer in respect of the proceedings pursuant to Part IV of the CCAA.

Bar Date: 
Pursuant to local practice in the U.S. Bankruptcy Court, a deadline for the filing of proofs of claim (the “Bar Date”) was established for all creditors of the Debtors upon commencement of the Chapter 11 Cases. No order in respect of the Bar Date has been entered in the Chapter 11 Cases. The U.S. Bankruptcy Court has set the following deadlines for filing proofs of claim: 

General Bar Date: October 15, 2024 

Governmental Bar Date: December 9, 2024 

Creditors of the Canadian Debtors and other Canadian-based creditors of the Chapter 11 Debtors, ARE NOT exempt from the Bar Date. For more information on the Bar Date and instructions for filing proofs of claim, please visit:
