Introduction
On March 9, 2011, the Supreme Court of British Columbia (the “Court”) made an order (the “Receivership Order”) appointing Alvarez & Marsal Canada Inc. as receiver and manager (the “Receiver”) without security, of all of the assets, undertakings and properties of 682202 B.C. Ltd. d.b.a. Cedarbrooke Chateau (“Cedarbrooke” or the “Debtor”) pursuant to section 243(1) of the Bankruptcy and Insolvency Act, section 39 of the Law and Equity Act and Rules 10-2 and 13-2(5) of the Supreme Court Civil Rules.
The Receiver has sold Cedarbrooke Chateau to Chartwell Master Care LP (“Chartwell”). The Court has approved the sale which closed on October 25, 2013.
