Mr. Voth brings more than 25 years of accounting and consulting experience spanning a variety of industries, including retail, telecommunications, software, technology, financial services, manufacturing and natural resources. Some of his representative clients include: Microsoft, Amazon.com, AT&T, Dollar Tree and Univar.
His notable engagements include: successful testimony in the often-cited copyright infringement indirect damages matter Mackie v. Reiser, 296 F.3d 909 (9th Cir. 2002); testimony for L’Oreal supporting its $11.6 million patent infringement, trade dress infringement and false advertising jury verdict against an infringer; a no-damage ruling in an underlying patent infringement legal malpractice claim in excess of a billion dollars; testimony in multiple class action matters where class certification was denied; and multimillion-dollar jury verdicts in various matters including breach of contract and theft of trade secret matters.
Mr. Voth assists attorneys and their clients with valuations, damages in disputes and investigations. His forensic accounting experience includes consulting with both plaintiffs and defendants through all phases of the dispute resolution process, including case assessment, pleadings preparation, discovery due diligence, financial analysis and reporting, deposition, and trial.
Mr. Voth brings his background in accounting, finance, valuation, economics and statistics to bear on earnings evaluations, reasonable royalty studies, valuations, damages studies and other areas. He has testified in trial and / or deposition in a variety of matters, including intellectual property infringement, class action, defamation, legislative investigation and breach of contract matters.
Mr. Voth's valuation and reorganization experience spans many clients and industries. Advisory engagements include: consulting on proper financial reporting, valuation, reorganization plans, disclosure statements, financing, asset sales, out-of-court workouts, and preference and fraudulent conveyance actions. Valuation engagements have ranged from enterprise valuations under a variety of operating assumptions to intellectual property valuations including patents, non-compete agreements and goodwill.
Mr. Voth earned a bachelor's degree in economics, with honors, from Pomona College. He is a Certified Public Accountant (Washington), AICPA Certified in Financial Forensics and is a Certified Valuation Analyst. He is also a Certified Fraud Examiner, a Certified Insolvency and Restructuring Advisor and is certified in Distressed Business Valuation. He is a member of the AICPA, the Association of Certified Fraud Examiners, the Association of Insolvency Advisors, the National Association of Certified Valuation Analysts and the Licensing Executives Society.
