Arbitrations between private parties or between investors and states have become more prevalent as a resolution mechanism in international business disputes due to the increasing costs and duration of litigation, burdensome discovery rules in some jurisdictions, the expansion of bi-lateral investment treaties and other confidentiality considerations.

These arbitrations, whether institutional (before the ICC, AAA, LCIA, ICSID, CIETAC, etc.) or ad-hoc (under UNCITRAL regulations, for example), have increased in number, with related trends driven by geopolitical and economic factors (flows of funds where governments are co-investors, occurrence of privatizations and expropriations of assets, investment issues concerning natural resources, etc.)
